An inspection by Chile's Labour Directorate comes without notice. The inspector arrives, shows credentials, asks for documents, walks the facilities, talks to workers and writes a report. What decides the outcome is not how much prevention you did, but how much you can prove at that moment. This article explains how fines are calculated and what to do before and after the visit.

Who inspects what

Chile has no single occupational safety inspector:

  • The Labour Directorate checks compliance with labour law and hygiene and safety rules: internal regulations, joint committee, training and PPE records, risk matrix, preventive programme and the Ley Karin protocol. It applies the DS 44 inspection form and issues administrative fines.
  • The SEREMI de Salud (regional health authority) checks the sanitary and environmental conditions of DS 594 and the application of the Ministry of Health surveillance protocols. Its sanctions go through a sanitary proceeding.
  • The mutual insurer does not fine, but its assessment affects the additional premium the company pays.

How fines are calculated

Fines are expressed in monthly tax units (UTM) and depend on company size, under article 506 of the Labour Code.

Three details change the final bill a lot:

  1. Each missing document is a separate infraction. Outdated regulations, a missing IRL and a committee without minutes are three fines, not one.
  2. Repeat offences and gravity double or triple the amount.
  3. Ley Karin infractions have their own scale and can reach 60 UTM per infraction in companies with 50 or more workers.

The most frequent mistakes

Most observations do not come from companies that do no prevention, but from real management that was never documented:

  • Training without a signed attendance list.
  • Personal protective equipment handed out with no record of who, when and with what instruction.
  • A joint committee set up but without monthly meeting minutes.
  • A three-year-old risk matrix with no annual review.
  • An emergency plan with no drill record.
  • Dangerous incidents without injuries that nobody wrote down.

If the fine has already arrived

Not all is lost. The Labour Code offers several ways out:

  • Correction within 15 days. If you prove you corrected the infraction, the fine is reduced by at least 50%. In micro and small companies, by at least 80%.
  • Substitution by an assistance programme. In micro and small companies the inspector may allow replacing the fine with enrolment in a compliance assistance programme, with technical support from the insurer.
  • Reconsideration. Within 30 working days you may ask for the fine to be cancelled or reduced by proving compliance.

What matters is acting fast with credible documentation. A document set signed the day before the review raises suspicion; an organised folder with consistent dates does not.

How to prepare before the visit

Preparation comes down to one question: can I show today, with a valid document, every point on the DS 44 checklist? If the answer is no on more than two points, a diagnosis is worth doing before the authority does it for you.
