Before you hire
What must my company have according to its number of workers?
Every company, from one worker up, needs an IPER matrix, a preventive work programme, job-specific risk information, training and a Ley Karin protocol. From 10 workers, internal regulations are added and, if there is no committee, a safety delegate. Over 25 workers the joint committee is mandatory. Under 100 you must appoint a trained prevention officer and over 100 a department led by an expert registered with the health authority.
What does the Labour Directorate check in an inspection?
It applies the DS 44 inspection form: internal regulations with signed receipt, job-specific IRL, a current IPER matrix, the preventive programme, joint committee minutes, training and PPE delivery records, an emergency plan with a drill, the Ley Karin protocol and the accident and incident register. It checks validity and evidence, not just existence.
Are my DS 40 documents still valid?
No. DS 44 repealed DS 40 and DS 54 on 1 February 2025. Regulations, an ODI or a programme citing those decrees are outdated and count as non-compliance, even if recently signed.
Am I obliged to hire a safety professional?
Only above 100 workers in mining, industrial or commercial companies, where a prevention department with an expert must exist. Below that number the law does not require hiring, but it does require meeting every obligation. That is why most SMEs work with an external safety professional.
Does Ley Karin apply to a small company?
Yes, to every employer from one worker up. You must have a protocol for preventing workplace harassment, sexual harassment and violence, a confidential complaint channel and an investigation procedure, even if no complaint has ever been filed.
